ADU Policy
2020 is an exciting time for ADUs, because significant pieces of legislation have recently passed in favor of easing the approval processes and regulations for ADU creation.
Senate Bill 13 reduces parking requirements, eases up on owner occupancy rules, and eliminates impact fees on ADUs under 750s.f.
Assembly Bill 670 changes rules so that an HOA cannot prevent someone from building an ADU
Assembly Bill 671 will require local governments to start to offer financial incentives and grants to some ADUs as affordable housing
Assembly Bill 881 and Assembly Bill 68 delete standards that limit building ADUs based on percent lot coverage, floor area ratio, and minimum lot size, with the intention of anyone having the right to plan for at least an 800 s.f. ADU that is at least 16 ft high and has 4 ft rear and side setbacks from property lines. Some locations will even be allowed both an ADU and a junior ADU now. Additionally, these bills cut permit processing time in half, requiring applications to be processed in 60 days or less.
